Po dvoch rokoch pand\u00e9mie, ktor\u00e9 priniesli \u00fatlm cestovn\u00e9ho ruchu, sa \u013eudia op\u00e4\u0165 rozcestovali na dovolenky. Cestovn\u00e9 obmedzenia po\u010das pand\u00e9mie sp\u00f4sobili, \u017ee leteck\u00e9 spolo\u010dnosti a\u00a0letisk\u00e1 museli prist\u00fapi\u0165 k\u00a0prep\u00fa\u0161\u0165aniu svojich zamestnancov. T\u00edto zamestnanci teraz ch\u00fdbaj\u00fa, v\u00a0d\u00f4sledku \u010doho cestuj\u00faci za\u017e\u00edvaj\u00fa \u00a0okrem dlh\u00e9ho \u010dakania na odbavenie bato\u017einy na letisk\u00e1ch, i\u00a0 ru\u0161enie alebo me\u0161kanie letov.<\/p>\n
Ak bol let z d\u00f4vodu \u0161trajku leteck\u00e9ho person\u00e1lu zru\u0161en\u00fd, cestuj\u00faci maj\u00fa pod\u013ea Nariadenia Eur\u00f3pskeho parlamentu a\u00a0Rady (ES) \u010d.\u00a0261\/2004<\/a>, pr\u00e1vo \u017eiada\u0165\u00a0 vr\u00e1tenie ceny letenky alebo presmerovanie na n\u00e1hradn\u00fd let v\u00a0najbli\u017e\u0161om mo\u017enom term\u00edne. Po 2 hodin\u00e1ch \u010dakania na n\u00e1hradn\u00fd alebo me\u0161kaj\u00faci let maj\u00fa cestuj\u00faci tie\u017e n\u00e1rok na bezplatn\u00e9 ob\u010derstvenie, 2 telefonick\u00e9 hovory alebo e-mailov\u00e9 spr\u00e1vy a\u00a0v\u00a0pr\u00edpade potreby aj na ubytovanie na nevyhnutn\u00fa dobu.<\/p>\n Pod\u013ea uveden\u00e9ho Nariadenia Eur\u00f3pskeho parlamentu a\u00a0Rady (ES) \u010d.\u00a0261\/2004, pokia\u013e neboli cestuj\u00faci informovan\u00ed o zru\u0161en\u00ed letu aspo\u0148 dva t\u00fd\u017edne pred pl\u00e1novan\u00fdm \u010dasom odletu, ako i\u00a0v\u00a0pr\u00edpade me\u0161kania letu trvaj\u00faceho viac ne\u017e 3 hodiny, maj\u00fa vo\u010di leteckej spolo\u010dnosti n\u00e1rok na finan\u010dn\u00fa n\u00e1hradu vo v\u00fd\u0161ke 250 a\u017e 600 eur v z\u00e1vislosti od d\u013a\u017eky letu, av\u0161ak len pokia\u013e me\u0161kanie alebo zru\u0161enie letu nebolo sp\u00f4soben\u00e9\u00a0 mimoriadnymi okolnos\u0165ami. Viac k\u00a0v\u00fd\u0161ke n\u00e1hrady sa dozviete napr\u00edklad \u00a0v\u00a0na\u0161om \u010dl\u00e1nku<\/a>.<\/p>\n Mimoriadna okolnos\u0165 zbavuje leteck\u00e9ho dopravcu povinnosti vyplati\u0165 cestuj\u00facim finan\u010dn\u00fa n\u00e1hradu pod\u013ea nariadenia Eur\u00f3pskeho parlamentu a\u00a0Rady (ES) \u010d.\u00a0 261\/2004. Ide o udalos\u0165,\u00a0 ktorej leteck\u00fd dopravca nemohol zabr\u00e1ni\u0165 ani vtedy, ke\u010f boli prijat\u00e9 v\u0161etky primeran\u00e9 opatrenia.<\/p>\n \u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 nesmie by\u0165 vlastn\u00e1 be\u017en\u00e9mu v\u00fdkonu \u010dinnosti leteck\u00e9ho dopravcu a<\/p>\n \u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 mus\u00ed by\u0165 \u00faplne mimo skuto\u010dnej kontroly leteck\u00e9ho dopravcu.<\/p>\n Medzi tak\u00e9to okolnosti sa\u00a0radia napr\u00edklad r\u00f4zne vplyvy po\u010dasia a\u00a0pr\u00edrodn\u00e9 katastrofy, napr\u00edklad siln\u00e1 hmla, hust\u00e9 sne\u017eenie, hurik\u00e1n, v\u00fdbuch sopky, \u010falej nepokoje v\u00a0cie\u013eovej destin\u00e1cii ako napr\u00edklad vojnov\u00fd konflikt.<\/p>\n Mimoriadnou okolnos\u0165ou, ktor\u00e1 zbavuje leteck\u00e9ho dopravcu povinnosti vyplati\u0165 cestuj\u00facim finan\u010dn\u00fa n\u00e1hradu \u00a0je za ist\u00fdch okolnost\u00ed \u0161trajk, \u010di\u017ee pr\u00e1vo zamestnancov zakotven\u00e9 v Charte z\u00e1kladn\u00fdch pr\u00e1v:<\/p>\n Ide napr\u00edklad o \u0161trajk zamestnancov\u00a0 letiska alebo riadiacich letovej prev\u00e1dzky, preto\u017ee tento \u0161trajk je mimo kontroly leteck\u00e9ho dopravcu a\u00a0net\u00fdka sa be\u017enej aktivity leteckej spolo\u010dnosti.<\/p>\n Povinnos\u0165 leteck\u00e9ho dopravcu vyplati\u0165 finan\u010dn\u00fa n\u00e1hradu je tak obmedzen\u00e1\u00a0 len na pr\u00edpady, ke\u010f \u0161trajkuje\u00a0pos\u00e1dka danej leteckej spolo\u010dnosti, teda zamestnanci nevyhnutn\u00ed na uskuto\u010dnenie letu. \u010ci v\u0161ak aj v\u00a0pr\u00edpade tak\u00e9hoto \u0161trajku skuto\u010dne i\u0161lo o\u00a0mimoriadnu okolnos\u0165,\u00a0 z\u00e1vis\u00ed v\u00a0pr\u00edpade sporu od toho, ako okolnosti konkr\u00e9tneho pr\u00edpadu pos\u00fadi s\u00fad.<\/p>\n V\u00a0roku 2018 S\u00fadny dvor E\u00da (\u010falej len \u201es\u00fadny dvor\u201c) spresnil<\/a>, \u017ee zru\u0161enie resp. dlh\u00e9 me\u0161kanie letov v d\u00f4sledku \u0161trajku nespad\u00e1 v\u017edy pod pojem mimoriadna okolnos\u0165. Cestuj\u00faci teda maj\u00fa n\u00e1rok na finan\u010dn\u00fa n\u00e1hradu v\u00a0[PP1]\u00a0pr\u00edpade, \u017ee d\u00f4jde k\u00a0naru\u0161eniu ich letov\u00e9ho pl\u00e1nu v d\u00f4sledku tzv. div\u00e9ho \u0161trajku. Ide o spont\u00e1nnu protestn\u00fa reakciu zamestnancov na rozhodnutie o\u00a0re\u0161trukturaliz\u00e1cii alebo reorganiz\u00e1cii, ktor\u00e1 nie je ofici\u00e1lne za\u010dat\u00e1 odbormi. M\u00f4\u017ee prebieha\u0165 formou v\u00fdziev aby si zamestnanci nahl\u00e1sili pr\u00e1ceneschopnos\u0165. V\u00fdsledkom je zv\u00fd\u0161en\u00e1 miera nepr\u00edtomnosti palubn\u00e9ho person\u00e1lu v\u00a0pr\u00e1ci.<\/p>\n V\u00a0roku 2021 s\u00fadny dvor e\u0161te viac roz\u0161\u00edril pr\u00e1va cestuj\u00facich<\/a>. Vo svojom rozhodnut\u00ed uviedol, \u017ee leteck\u00fd dopravca nie je osloboden\u00fd od povinnosti zaplati\u0165 finan\u010dn\u00fa n\u00e1hradu za zru\u0161enie alebo ve\u013ek\u00e9 me\u0161kanie pr\u00edslu\u0161n\u00fdch letov ani v\u00a0pr\u00edpade riadneho \u0161trajku organizovan\u00e9ho odborovou organiz\u00e1ciou svojich zamestnancov, preto\u017ee za\u010diatok \u0161trajku je pre dopravcu predv\u00eddate\u013en\u00fd a v d\u00f4sledku toho si zachov\u00e1va kontrolu nad touto udalos\u0165ou, ke\u010f\u017ee m\u00e1 v z\u00e1sade mo\u017enos\u0165 vopred sa pripravi\u0165 a pr\u00edpadne zmierni\u0165 jeho d\u00f4sledky.<\/p>\n Prev\u00e1dzkuj\u00faci leteck\u00fd dopravca je povinn\u00fd zabezpe\u010di\u0165, aby pri odbavovan\u00ed cestuj\u00facich bolo vidite\u013en\u00fdm sp\u00f4sobom umiestnen\u00e9 upozornenie, ktor\u00e9 obsahuje nasledovn\u00fd text: „Ak v\u00e1m bol odmietnut\u00fd n\u00e1stup do lietadla, alebo ak je v\u00e1\u0161 let zru\u0161en\u00fd alebo ome\u0161kan\u00fd aspo\u0148 dve hodiny, po\u017eiadajte pri odbavovacom pulte alebo n\u00e1stupnom v\u00fdchode o p\u00edsomn\u00e9 inform\u00e1cie o va\u0161ich pr\u00e1vach, najm\u00e4 o finan\u010dnej n\u00e1hrade a pomoci.<\/em>\u201c<\/p>","protected":false},"excerpt":{"rendered":"Po dvoch rokoch pand\u00e9mie, ktor\u00e9 priniesli \u00fatlm cestovn\u00e9ho ruchu, sa \u013eudia op\u00e4\u0165 rozcestovali na dovolenky.
